1. Parties, subject matter and acceptance
These Terms and Conditions ("Terms") govern the purchase and use of GolfEvo ("Service") by a natural person ("User" or "you"), offered by DISCERNIA CONSULTORIA TECNOLOGIA E EDUCAÇÃO LTDA., enrolled in the CNPJ (Brazilian corporate taxpayer registry) under No. [TO FILL IN], headquartered in São Paulo, SP, [TO FILL IN — full address] ("Discernia", "we").
By completing the online purchase or by accessing the platform, you declare that you have read, understood and accepted these Terms and the Privacy Policy. If you do not agree, do not purchase or use the service.
You declare that you are over 18 years of age and fully capable. The service is intended for professionals and is not offered to minors.
2. Definitions
"Platform": Discernia's digital environment through which the service is provided, including interfaces, content, simulations, artificial intelligence agents and preparation tools.
"Content": cases, materials, scripts, topic maps, lessons, guidance, texts, images, videos and other materials made available by Discernia.
"Results": the artifacts produced by the User/Participant during use (answers, decisions, documents, voice recordings converted to text, uploaded videos), as well as the debriefings, feedback and reports generated by the Platform.
"Artificial intelligence" or "AI": the automated systems operating on the Platform. Everything generated by AI on the Platform is identified as such; no human being poses as AI, and no AI poses as a human being.
3. Subject matter: swing analysis and guidance
GolfEvo is a video-based golf swing analysis service, with recognition of the phases of the movement, extraction of biomechanical measurements, generation of prioritized guidance ("Orientação da semana" — Guidance of the week) and a progress record ("Dossiê de evolução" — Evolution dossier), following the methodology of the instructor linked to the user, where there is one.
The individual subscription includes a monthly quota of analyses [TO FILL IN]; additional analyses may be purchased at a fixed price stated on the Platform. Reference price: [TO FILL IN — price in reais; international reference US$ 12/month or US$ 119/year].
The AI observes and measures; the instructor interprets, prioritizes and teaches. The service does not replace the instructor, nor medical or physiotherapy guidance.
4. Videos, image and personal data
Uploaded videos contain the user's image and are personal data. They are processed for the performance of the contract (analysis, guidance, dossier) and stored in isolation per user and per instructor. The user declares that they hold the rights to the uploaded images and that any third parties appearing in the video have authorized the recording.
Curation and system learning: adjustments made by the instructor to the analyses are used to improve that instructor's own guidance (isolated methodology). The use of videos and adjustments for the general improvement of Discernia's models depends on specific, revocable consent, requested on the Platform [LEGAL DECISION].
You may request deletion of the videos at any time by emailing privacidade@discernia.com.br; deletion prevents the continuation of the dossier for the deleted videos.
5. Sports practice and responsibility
Playing golf involves physical effort. The user is responsible for evaluating their own health condition and for practicing safely; the guidance is technical and does not take medical conditions into account. In case of pain or injury, stop and seek a healthcare professional.
Measurements extracted by AI may contain inaccuracies arising from framing, lighting, distance or video quality. The Platform provides guidance on how to record; low-confidence analyses may be refused or marked as inconclusive without consuming the quota.
6. Instructors and methodology
If you are linked to an instructor who uses GolfEvo, the guidance follows their methodology and they will have access to your videos, analyses and dossier for teaching purposes. You may unlink at any time on the Platform.
7. Purchase, term and renewal
Purchase is made online, by choosing the product and plan, filling in your details and confirming payment. Purchase confirmation and access credentials are sent to the email address provided within 1 (one) business day after payment approval.
The term begins when access is granted and corresponds to the period of the plan purchased, as per the product-specific clause. There is no automatic renewal: at the end of the period, Discernia may offer renewal, which will depend on a new express purchase.
Discernia may refuse or cancel purchases in case of suspected fraud, misuse, breach of these Terms or inability to confirm the information provided, with a full refund of the amounts paid where applicable.
8. Price and payment
The price is the one stated on the purchase page at the time of purchase and will appear in the confirmation email. Amounts are in Brazilian reais and include the taxes levied on the provision of the service.
Payment is made by credit card, through a third-party payment provider. Discernia does not store card data. Installment plans, when offered, are indicated on the purchase page; refusal of an installment by the card issuer may suspend access until the matter is resolved.
Price adjustments apply only to new purchases or renewals; the contracted price is maintained throughout the term.
9. Withdrawal, cancellation and termination
Right of withdrawal: as this is a distance contract, you may withdraw within 7 (seven) calendar days from the purchase or from the start of access, whichever occurs later, with a full refund of the amounts paid, under art. 49 of the Consumer Defense Code (CDC). The request must be sent to contato@discernia.com.br.
Cancellation after the withdrawal period: you may cancel at any time, effective at the end of the current month or installment; amounts already paid for periods already made available are not refunded, and upcoming installments for periods not made available will not be charged. [LEGAL DECISION — retention/penalty rule, if any.]
Discernia may terminate the contract, upon notice, in case of serious breach of these Terms (in particular the rules on use and confidentiality), without refund of the amounts for the period already made available.
10. Access and credentials
Access credentials are personal and non-transferable. You are responsible for keeping them confidential and for all activities carried out with them. Sharing credentials, assigning access or allowing use by a third party constitutes a breach of these Terms.
Access is made through the address provided in the confirmation, with an up-to-date browser and an internet connection, which are the User's responsibility. Voice features depend on a microphone and on browser permissions.
Discernia may suspend access for security reasons, scheduled maintenance (communicated with reasonable notice) or suspected misuse, for the time needed to investigate.
11. Rules of use and confidentiality
It is prohibited to: (i) enter into the Platform confidential or secret information, or information protected by a legal or contractual duty of confidentiality, including that of an employer or client; (ii) enter third parties' personal data without a legal basis; (iii) use the Platform for unlawful, discriminatory or harassing purposes; (iv) attempt to circumvent usage limits, or to extract, copy, scrape or reverse-engineer Content, models, prompts or cases; (v) use the Platform to develop a competing product; (vi) reproduce or distribute Content without authorization.
The Platform's cases, characters and materials are built for simulation or for teaching. You acknowledge that the service's architecture starts from the rule that real confidential data never enters the Platform, and that Discernia is not an authorized perimeter for corporate data.
Discernia may apply guardrails and automated and human sample review of interactions to ensure the security, compliance and quality of the service, as per the Privacy Policy.
12. Nature of the service and limits
The service is educational and developmental in nature. Discernia does not predict future performance, does not issue psychological diagnoses, does not pass judgment on the person and does not replace human decisions — those of a board, an executive, a teacher or the User themselves.
Content and feedback are educational and do not constitute legal, financial, accounting, medical or regulatory advice. Decisions made on the basis of the use of the Platform are the sole responsibility of those who make them.
AI systems may produce incorrect, incomplete or outdated information. The Platform is designed to reduce this risk (sources, verification, guardrails), but does not eliminate it. You must verify facts, figures and sources before using them outside the Platform.
Discernia does not guarantee any specific result, approval, promotion, third-party certification, performance in external evaluations or obtaining a position. Metrics and measurements produced by the Platform refer to what was observed during use and follow the criteria declared in the method, including the LUMEN standard, published openly and in the process of validation.
13. Intellectual property
The Platform, the Content, the trademarks (Discernia, Beatriz, GolfEvo, AI-Ready, LUMEN and their respective signs), the method, the cases, the topic maps, the prompts and the agent models are owned by Discernia or its licensors and are protected by intellectual property law. Purchase grants only a personal, limited, non-exclusive and non-transferable license to use, for the duration of the term.
The Results produced by the User (answers, documents, decisions, uploaded videos) remain the User's property. You grant Discernia a license to store and process them for the provision of the service, for the generation of feedback and for the improvement of the method in aggregated and anonymized form, as per the Privacy Policy.
Debriefings, feedback and reports generated by the Platform are intended exclusively for the User and may not be presented as a certification or evaluation issued by third parties.
14. Personal data and privacy
Discernia processes personal data in accordance with Law No. 13,709/2018 (LGPD, the Brazilian General Data Protection Law) and the Privacy Policy, which forms part of these Terms. Main legal bases: performance of the contract (registration, access, provision of the service), compliance with a legal obligation (tax), legitimate interest (security and service improvement, with minimization measures) and consent, where required.
Usage data (interactions, Results, feedback) is isolated per User and is not shared with third parties, except for the processors necessary for the provision of the service (hosting, AI model providers, payment, email), bound by contract and to the purposes set out herein. When processing takes place outside Brazil, the international transfer complies with the LGPD.
Retention: data is kept during the term and for up to [TO FILL IN] months after termination, for accountability, legal deadlines and the defense of rights; afterward, it is deleted or anonymized. You may exercise your rights of confirmation, access, correction, portability, deletion, information and withdrawal of consent by emailing privacidade@discernia.com.br. Data Protection Officer: [TO FILL IN].
15. Availability, support and updates
Discernia will use reasonable efforts to keep the Platform continuously available, with an availability target of [TO FILL IN]% per month, excluding scheduled maintenance, third-party failures (cloud providers, AI model providers, connectivity) and force majeure events.
Support: by email (contato@discernia.com.br), on business days, from 9 a.m. to 6 p.m. (Brasília time), with a first response within [TO FILL IN] business hours.
Discernia may update the Platform, the Content and the AI models used, including by replacing suppliers, provided that the essential nature and quality of the service are maintained.
16. Liability
Discernia's liability is limited to direct damages proven to have been caused by a failure in the provision of the service, subject to the Consumer Defense Code (CDC). Discernia is not liable for decisions made by the User on the basis of the use of the Platform, for unavailability caused by third parties or for use in breach of these Terms.
Nothing in these Terms excludes or limits rights that consumer protection law guarantees as non-waivable.
17. Changes to these Terms
Discernia may amend these Terms to reflect legal, technical or service changes. Material changes will be communicated by email or by notice on the Platform at least 15 (fifteen) days in advance. If you do not agree, you may cancel at no cost before they take effect; continued use after the stated date constitutes acceptance.
18. General provisions
These Terms are governed by Brazilian law. The courts of the User's domicile are elected to settle disputes, in accordance with the Consumer Defense Code (CDC), without prejudice to the official consumer dispute resolution platforms.
Tolerance of non-compliance with any clause does not imply waiver. If any provision is held invalid, the others remain in force. Valid communications: contato@discernia.com.br and the email address provided at purchase.
Versions in other languages are courtesy translations; in case of discrepancy, the Portuguese version prevails.
